Terms of Service

1. Acceptance of Terms

By accessing or using TenantAIQ ("the Service"), operated by FinFlow Labs LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TenantAIQ is an AI-powered property management platform that provides automated tenant communication via SMS, rent collection, maintenance tracking, lease management, and related services for landlords and property managers.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Subscription Plans and Billing

Free Trial: New accounts receive a 30-day free trial. No charge during the trial period.
Billing: After the trial, subscriptions are billed monthly at the rate corresponding to your plan (Starter $49/mo, Growth $99/mo, Portfolio $249/mo).
Cancellation: You may cancel at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
Price Changes: We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.

5. SMS Communication and TCPA Compliance

By using TenantAIQ, you represent that you have obtained proper consent from your tenants before adding them to the platform and enabling SMS communication.
You are responsible for ensuring your tenants have agreed to receive text messages related to their tenancy.
TenantAIQ sends transactional messages only: rent reminders, maintenance updates, lease information, and emergency notifications. No marketing messages are sent.
Tenants may opt out of SMS communication at any time by replying STOP to any message.

6. AI-Generated Communications

TenantAIQ uses artificial intelligence to generate responses to tenant inquiries. While we strive for accuracy and professionalism, AI-generated communications should not be considered legal advice. You are ultimately responsible for all communications sent to your tenants through the platform.

7. Legal Documentation

The Legal Documentation Generator creates chronological records of communications, payments, and maintenance requests. These documents are provided for informational purposes and should be reviewed by a qualified attorney before use in legal proceedings. TenantAIQ does not provide legal advice.

8. Payment Processing

Rent payments are processed through Stripe. TenantAIQ does not store credit card or bank account information directly. Payment processing fees apply as disclosed at the time of transaction. Landlords are responsible for connecting their bank account through Stripe Connect to receive tenant rent payments.

9. Tenant Screening

Tenant screening services are provided through third-party partners. You agree to use screening results in compliance with the Fair Credit Reporting Act (FCRA) and all applicable fair housing laws. Screening results must not be used to discriminate based on race, color, religion, sex, national origin, disability, or familial status.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process personal data as described therein. You are responsible for ensuring your use of tenant data complies with applicable privacy laws.

11. Prohibited Uses

You agree not to:

Use the Service for any unlawful purpose or in violation of fair housing laws
Send harassing, threatening, or discriminatory messages through the platform
Attempt to circumvent security measures or access other users' data
Use the Service to send marketing or spam messages to tenants
Misrepresent AI-generated communications as human-generated for legal purposes

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINFLOW LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless FinFlow Labs LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by maintenance, updates, or circumstances beyond our control.

15. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kings County, New York.
